Austria puts an end to the “parking rip-off” business model – new rules in place since January 1, 2026

A quick stop at the side of the road or a turning manoeuvre and suddenly the car is 'parked'. Until now, affected drivers often faced high legal fees and the threat of court proceedings. Drivers looking for parking spaces were particularly affected. This practice was used as a lucrative business model not only in Austria, but also in other countries. However, the Austrian government is now putting a stop to this. Since 1 January 2026, new regulations have been in force to prevent the 'parking rip-off' business model (BMJ, 2025).

 

Problem: Profit through intimidation

Legal actions for trespassing have up until now frequently cost several hundred euros, putting pressure on those impacted to pay right away. Depending on the law firm and the case, those who paid right away after receiving the letter were able to avoid costly court fees, but they still had to pay between €100 and €400. Law firms found this strategy to be a profitable business model because it allowed them to make money without going to court.

 

Solution: New legal regulations

Among other things, the reform provides for:

Reduced legal fees: In future, legal fees for trespass lawsuits will only amount to around € 107.76. In court proceedings, the standard cost is € 70, but if the lawsuits are withdrawn before service, the cost drops to € 35 – and under certain conditions to € 40.

Access to the Supreme Court: Disputes over motor vehicle trespass can now be heard by the Supreme Court even for small claims, ensuring uniform case law.

Protection against abuse: Only genuine trespass remains actionable; abusive threats, e.g., for short stops or turning maneuvers, are effectively prevented.

Minister of Justice Anna Sporrer explains: “One turning maneuver and a letter from a lawyer flutters into your house. We are taking away what keeps the ‘parking rip-off’ business model alive: profit. We are limiting legal fees and creating legal certainty.”
