Video instead of statement: Dashcams in accident investigations
Can a car camera be used as decisive evidence in court?
A judgement by the District Court of Frankenthal, Germany, explains the role of dashcams in modern vehicles in investigating traffic accidents. In these cases, dashcams act as silent witnesses. Therefore, they can provide significant evidence.
Accident involving an open car door: dashcam clarifies controversial events.
The importance of dashcams is growing, and one example is the 'dooring' accident. A Tesla driver parked on the roadside and opened the rear door to let out his two-year-old daughter. Meanwhile, a passing car crashed into the door, causing damage of more than €8,000.
However, the most important thing is the testimony. The driver of the other car claims that the door was opened suddenly. However, the dashcam recorded the entire incident, showing that the door had been open for some time.
Result: The video contradicts the driver who caused the accident.
Data protection does not necessarily conflict with the need for evidence.
The judge’s decision shows that privacy concerns do not conflict with fundamental rights. The consideration of interests in each individual case is what matters. Documented neutral traffic operations can especially be utilised in court.
The legitimacy of dashcams in court
15 May 2018: The leading decision already determined that dashcam recordings can be used despite possible violations of data protection laws. However, a significant balancing of interests is required between personal rights and the interest in clarifying an accident. This has been confirmed by the district court of Saarbrücken and the state labour court. However, the regional court in Mühlhausen is critical of this, calling for legal regulation of dashcam use as evidence.
Drivers with a dashcam in their vehicle not only drive more safely, but also have a clear advantage in court when seconds matter and every image can determine guilt and liability.
