A trailer is always “towed”


It is irrelevant whether the trailer is being towed regularly, the car is reversing, for example, or is being pushed during a maneuver. Paragraph 19 of the Road Traffic Act refers to the liability of a motor vehicle in the event of an accident involving a trailer. However, the paragraph covers any situation involving a trailer, regardless of the direction of travel. Although the wording of the law has been amended, this does not change anything. The new version was not intended to change the content, it was simply a linguistic change. Paragraph 19 of the StVG is an abstract provision that a trailer is carried. In the end, however, it always depends and there can also be exceptions. For example, if the trailer is too long, too wide or poses a particular danger as a heavy load, exceptions may apply. The Federal Court of Justice recently clarified this again and confirmed a decision by the regional court with jurisdiction. A trailer is always towed, regardless of which direction you are driving in.
